Introduction

These Terms and Conditions govern the use of services provided by Golden White Real Estate, a real estate brokerage agency licensed by the Dubai Land Department (DLD) and operating in Dubai, United Arab Emirates. By engaging our services or accessing our website, you agree to be bound by these terms, which comply with UAE laws, including Real Estate Brokerage Law No. 85 of 2006, Dubai Law No. 7 of 2006, and other regulations enforced by the Real Estate Regulatory Agency (RERA).

1. Scope of Services

Golden White Real Estate acts solely as a real estate broker facilitating transactions in the following markets:

  • Secondary Market: Brokering sales between property owners and buyers.
  • Off-Plan Market: Facilitating transactions between developers and buyers for properties under construction.
  • Leasing and Renting: Arranging lease agreements between property owners (landlords) and tenants.

We assist clients with transaction-related activities, including preparing legal documents, processing payments (e.g., cheques), and registering contracts with RERA’s Ejari or Oqood systems. We do not provide property management, maintenance, or other services beyond brokerage.

2. Client Obligations

When engaging our services, you agree to:

  • Provide Accurate Information: Submit accurate and complete personal and transaction-related information, including identification documents (e.g., Emirates ID, passport, residency visa) and financial details required for compliance with UAE laws.
  • Comply with UAE Regulations: Adhere to all applicable laws, including DLD and RERA requirements for property transactions, lease registrations, and AML compliance.
  • Pay Fees and Commissions: Pay agreed-upon brokerage fees and commissions as outlined in the brokerage agreement, in accordance with Real Estate Consumer Protection Law No. 19 of 2020. Fees must be clearly documented and agreed upon by all parties.
  • Cooperate in Transactions: Provide necessary documentation and cooperate with counterparties (e.g., owners, buyers, developers, or tenants) to complete transactions.

3. Our Responsibilities

As a licensed real estate brokerage, we commit to:

  • Acting with Integrity: Facilitate negotiations between parties with honesty and transparency, as required by Real Estate Brokerage Law No. 85 of 2006.
  • Compliance with Laws: Ensure all transactions comply with UAE and Dubai regulations, including registration of lease agreements (Ejari) and off-plan sales (Oqood) with RERA.
  • Confidentiality: Protect your personal information in accordance with our Privacy Policy and UAE Federal Law No. 45 of 2021.
  • Due Diligence: Conduct customer due diligence and AML checks as mandated by UAE law, including reporting suspicious transactions to the UAE Financial Intelligence Unit (FIU).

We are not responsible for property maintenance, disputes arising after contract completion, or services outside our brokerage scope.

4. Brokerage Fees and Payments

Fee Structure: Brokerage fees are agreed upon in writing in the brokerage agreement, as required by Real Estate Consumer Protection Law No. 19 of 2020. Fees typically include a percentage of the transaction value (e.g., 2% for property sales, as per market practice).

Payment Terms: Fees are payable upon successful completion of the transaction, unless otherwise agreed. For leasing, tenants may be required to provide post-dated cheques, which we facilitate but do not manage.

Additional Costs: Clients are responsible for DLD registration fees (e.g., 2% for property transfers, 5% housing fees for tenants), RERA fees, and other government charges, as outlined in Dubai Law No. 7 of 2006 and Decree No. 43 of 2013.

5. Transaction Process

Secondary Sales: We facilitate negotiations, prepare sale agreements, and assist with DLD registration. Buyers must deposit 10-20% of the property value, with the balance paid as per the contract.

Off-Plan Sales: We connect buyers with developers, assist with Oqood registration, and ensure compliance with Dubai Law No. 13 of 2008. Buyers typically pay in installments, as agreed with the developer.

Leasing and Renting: We draft lease agreements, facilitate Ejari registration, and assist with payment arrangements (e.g., post-dated cheques). Tenants must return the property in its original condition, subject to normal wear and tear, as per Dubai Law No. 26 of 2007.

Documentation: We assist with preparing and submitting required documents, including identification, contracts, and payment records, to ensure compliance with RERA and DLD requirements.

6. Limitations of Liability

  • Broker Role: We act as intermediaries and are not liable for disputes between parties (e.g., owners, buyers, developers, or tenants) after the transaction is completed.
  • Information Accuracy: We rely on information provided by clients and counterparties. We are not liable for losses arising from inaccurate or incomplete information provided by you or third parties.
  • Legal Disputes: Any disputes arising from transactions must be resolved through the Rental Disputes Settlement Centre (RDSC) or Dubai courts, as per Decree No. 26 of 2013.
  • Force Majeure: We are not liable for delays or failures caused by events beyond our control, including government actions, natural disasters, or system outages.

7. Termination of Services

By Client: You may terminate our services by providing written notice, subject to any outstanding fees or obligations under the brokerage agreement.

By Us: We may terminate services if you fail to comply with these terms, provide false information, or engage in illegal activities, as prohibited by UAE law.

Effect of Termination: Upon termination, you remain liable for any fees or costs incurred up to that point. We will cease processing your transaction but may retain records as required by UAE AML regulations.

8. Website Usage

  • Access: Our website is provided for informational and transactional purposes. You agree not to misuse the website, including hacking, data scraping, or introducing malicious code.
  • Content: All content on our website (e.g., listings, images, text) is owned by Golden White Real Estate or licensed to us. You may not reproduce or distribute content without permission.
  • Availability: We do not guarantee uninterrupted access to our website and are not liable for downtime caused by technical issues or maintenance.

9. Governing Law and Dispute Resolution

Governing Law: These Terms and Conditions are governed by the laws of the UAE and the Emirate of Dubai, including Federal Law No. 5 of 1985 (Civil Code) and Dubai real estate regulations.

Dispute Resolution: Any disputes arising from these terms or our services will be resolved through the Rental Disputes Settlement Centre (RDSC) for leasing issues or Dubai courts for other matters, as per Decree No. 26 of 2013.

10. Amendments

We may update these Terms and Conditions to reflect changes in our services or legal requirements. We will notify you of significant changes via email or our website. Continued use of our services after such changes constitutes acceptance of the updated terms.
